Terms & Conditions of Use

By entering and using the facilities at Lava Laundry Lounge (referred to in this document as “Lava”, “we”, “us”, or “our”), located at 181 Adelaide Terrace East Perth, Western Australia, you (“you”, “the customer”, or “user”) agree to comply with and be bound by the following Terms and Conditions of Use. If you do not agree with any of these terms, you must not use our facilities.
 

1. DEFINITIONS
 

  • "Facility" means the premises and equipment provided by Lava at its laundromat location.

  • "Unattended Laundry" refers to items left in machines or on premises without the customer being present.

  • "Back-of-House" refers to staff-access-only areas not open to the public.

  • "Non-Domestic Laundry" means any item not ordinarily used in a residential household setting, including but not limited to commercial, industrial, or heavily soiled items, pet bedding, mop heads, commercial cleaning items, hazardous materials, or items containing rigid, mechanical, or non-clothing fabric components.
     

2. UNATTENDED LAUNDRY AND CUSTOMER PROPERTY
 

2.1 No Responsibility for Unattended Items

Lava is an unattended self-service laundromat.  You must remain with your belongings while using the facility.  Lava accepts no responsibility for loss, theft, or damage to any item left unattended on the premises.

 

2.2 Removal of Items from Machines

To ensure fairness and operational efficiency, Lava reserves the right to remove laundry left in machines unattended and where wash or dry cycles are completed.  This is particularly necessary during peak periods to ensure machine availability for other users.

 

2.3 Storage of Unattended Items

If laundry is left on the premises for an extended period (whether in our machines or elsewhere in Lava), it may be transferred to a secure, back-of-house location.  Collection of such items must be arranged at a time convenient to staff, and identification may be required. Items uncollected within 30 days may be considered abandoned and disposed of, recycled, or donated to charity at our discretion.

 

3. ACCESS HOURS
 

3.1 Facility Access Times

Lava Laundry Lounge is open daily from 7:00AM to 11:00PM].  Doors automatically lock at 11:00PM sharp. No re-entry is permitted after closing time and no washing machines can be started after 10:30AM.

 

3.2 No Out-of-Hours Access

Lava does not provide after-hours access under any circumstances, including for retrieval of laundry left on premises or forgotten items.

 

3.3 Trespassing Out -of-Hours

 

Should you remain on premises out-of-hours it is considered as trespassing under Section 70A of the Criminal Code Act Compilation Act 1913 and you will be charged by the Western Australian Police and liable for a fine of $12,000 or imprisonment for 12 months.

4. BEHAVIOUR AND SUITABILITY

4.1 Right to Refuse Entry or Service
 

We reserve the right to refuse entry or service, and/or issue a notice of trespass to any person who:
 

  • Is disruptive or abusive to other customers or staff;

  • Engages in conduct deemed inappropriate or unsafe;

  • Attempts to wash Non-Domestic Laundry items.
     

4.2 Suspension of Payment Methods

We may decline or block the use of specific credit cards numbers or payment methods if they are linked to misuse of our services (e.g. payment disputes, fraud attempts, or you had been banned from the premises).

 

5. SURVEILLANCE AND MONITORING
 

5.1 Use of Surveillance Devices

Lava operates video and audio surveillance systems (including face recognition) for the purpose of monitoring and protecting the facility, its users, and assets.

 

5.2 Legal Authority for Surveillance

These recordings are made in compliance with the Surveillance Devices Act 1998 (WA), specifically under Section 3(1)(b)(ii) and Section 6(1), which permits the use of optical and audio surveillance in non-private areas for legitimate operational purposes.

 

5.3 Use of Recordings

Recordings may be used to investigate misconduct, resolve disputes, ensure safety, and assist law enforcement. By entering the premises, you consent to such recordings.

 

6. LIMITATION OF OUR LIABILITY
 

6.1 Lava is not liable for:
 

  • Any loss or damage caused by failure of machinery;

  • Damage to garments due to incorrect customer use or unsuitable items;

  • Any costs associated with the loss or delayed retrieval of laundry;

  • Personal injury or property damage occurring on the premises, unless caused by gross negligence on our part.
     

7. CUSTOMER RESPONSIBILITIES
 

You are solely responsible for:
 

  • Selecting appropriate wash and dry settings;

  • Using suitable detergents;

  • Following garment care advice for each specific item you launder;

  • Checking machines for forgotten items before and after use;

  • Following posted safety and instructional signage at the facility.

8. YOUR LIABILITY FOR DAMAGE
 

If you operate our equipment in a manner that results in damage — including through the laundering of Non-Domestic Laundry — you may be held personally liable for the full cost of repair, replacement, or servicing required to return the equipment to working order and condition.  This includes incidental costs such as technician call-out fees, parts, labour, and any operational downtime suffered by Lava.
 

8.3  Right to Recover Costs

We reserve the right to recover such costs through any lawful means, including contacting you through payment details used at the time of machine operation and/or pursuing debt recovery or legal action where appropriate.

9. REFUND POLICY
 

9.1 Refunds for Machine Malfunction

Lava will provide a full refund in the event that a machine fails to operate or complete its cycle as expected due to a fault or malfunction not caused by the user.

9.2  How to Request a Refund

To request a refund, you must notify us within 7 days of the event, by submitting a message through the 'Contact Us' tab on our official website (above).  Please include the following information to assist in our investigation and CCTV review:

- The name of the machine used;

- The date and approximate time used;

- The last four digits of the credit card used;

- A brief description of the issue you experienced.

9.3  Investigation and Response

We will investigate all refund requests promptly.  If verified, a full refund will be issued to the original payment method.  Once a refund is authorised it can take up to three business days to appear as a credit on your card account. Lava reserves the right to decline a refund if a machine is found to be in normal working order or if insufficient details are provided to verify the claim.

9.4  No Refunds for User Error

Refunds will not be provided for issues relating to incorrect operation, not following machine instructions, misuse of machines (including the laundering of unsuitable items), or failure to follow instructions displayed on-site. 

10. AMENDMENTS TO TERMS
 

We may update these Terms and Conditions at any time without prior notice.  Updates will be posted on our website.  Continued use of the facility after changes constitutes acceptance of those changes.
 

11. GOVERNING LAW
 

These Terms and Conditions are governed by the laws of Western Australia. Any disputes arising from or relating to the use of the Lava facility will be subject to the exclusive jurisdiction of the courts of Western Australia.
